Polar Data Catalogue Terms of Use

Version 2.0: Effective July 01, 2025

The Polar Data Catalogue (PDC) Research Data Infrastructure (RDI) consists of a public website, a searchable database of metadata, accessible archives of public datasets (not all datasets are publicly available), an Application Programming Interface (API), and various other online tools and components. The PDC RDI contents and resources have been compiled by the Canadian Cryospheric Information Network (CCIN) and the PDC and CCIN are members of the Waterloo Climate Institute (WCI), at the University of Waterloo.

Acceptable Use of RDI Contents and Resources

Use of the PDC RDI contents and resources is subject to the following conditions: Please read them carefully. By accessing and using any component of the PDC RDI, you are agreeing to be bound by the terms and conditions of use set out below. If you cannot or do not wish to be bound by these Terms of Use, you must immediately discontinue any use of the PDC RDI, and the contents and resources contained herein.

General: Unless otherwise specified, use of PDC RDI contents and resources requires formal authorization from CCIN and WCI prior to such use. Note that certain ancillary resources used by PDC in its RDI might contain their own Terms of Use, and in such cases, the present Terms of Use cannot and does not supersede such terms: It is your obligation to understand any third party transitive restrictions.

PDC Metadata: You may freely use, distribute, remix, adapt, and build upon acquired metadata in any medium or format, for noncommercial purposes only. Commercial use of PDC metadata requires formal authorization from CCIN and WCI prior to such use.

PDC Datasets: Unless otherwise specified, a Researcher grants you a limited license to make personal use only of their Content. Such grant does not include, without limitation: (a) any resale or commercial use of this Content; (b) modification, adaptation or translation of any data not intended to be modified, adapted or translated; (c) copying, imitating, mirroring, reproducing, distributing, publishing, downloading, displaying, performing, posting or transmitting any Content in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording or otherwise. You are not conveyed any right or license by implication, estoppel, or otherwise in or under a patent, trademark, copyright, or proprietary right of ArcticNet, other research programs, CCIN, the Researcher or any third party. However, there may be individual cases where a Researcher has elected to waive some of these restrictions through the inclusion of an external ancillary license, such as a Creative Commons (CC) license. In such cases, your license to reuse this Content will reflect the terms of the license chosen by the Researcher. Note that such permissions apply solely to the corresponding research artifacts and do not grant any additional rights to other Content, and all stated terms of use for this Database remain in force. Note that in the event of any unforeseen conflicts, the aforementioned default terms of use shall supersede all ancillary licensing. If you are unclear about ancillary licensing, or if you want to accomplish an act that is clearly forbidden under this Section, you have to contact the Researcher owning the Content you are targeting, in order to obtain written consent from him/her authorizing you to act. Access to RDI

CCIN may terminate your use of, or access to, the RDI if you make or permit any unauthorized use of the contents, resources, public website, and/or other assets and agreements. Unauthorized use of this RDI may include, but is not limited to:

  • using the RDI in violation of any law, rule, or regulation
  • interfering with or disrupting the PDC website, or any associated computer systems, servers, networks, databases, software, hardware, or equipment used to operate the RDI
  • interfering with the use or enjoyment of this RDI by others
  • attempting to inject malicious or harmful code, such as Cross-Site Scripting or SQL injections
  • attempting to gain unauthorized access to our computer systems, servers, networks, databases, software, hardware, or equipment, including to: user-restricted areas of the website; logins and passwords of others; or personal information and personal accounts of others

User Contributed Content

PDC allows you and others to submit content to its website. If you choose to submit content, please be civil and respectful. You must not:

  1. mislead us or anyone else as to your identity or the origin of the submitted content, or falsely claim to represent a person, organization, or entity
  2. post or transmit any message, content, or link to content that:
    • you either do not own or do not have the necessary rights to post or transmit
    • is in violation of any law, rule, or regulation or any third party right, or promotes illegal activity or conduct that would contravene any law, rule or regulation or third-party right
    • is abusive, hateful, homophobic, discriminatory, malicious, aggressive, threatening, violent, sexist, harassing, inflammatory, indecent, tortious, defamatory, knowingly false, misleading, deceptive, vulgar, obscene, offensive, scandalous, sexually explicit, profane, offensive, or otherwise objectionable
    • incites hatred, racism, bigotry, or physical harm of any kind
    • is unsolicited or unauthorized, such as unsolicited or unauthorized advertising, promotional material, "junk mail," "spam," "chain letter," "pyramid scheme," or any other form of solicitation (commercial or otherwise)
    • is in breach of any confidence
    • includes personal data or information about others
    • can result in us being liable to anyone else under any intellectual property rights law

THE RESEARCH DATA INFRASTRUCTURE AND ALL ITS CONTENTS AND RESOURCES ARE PROVIDED TO YOU "AS IS" AND “AS AVAILABLE.” YOU MUST NOT REPLY ON ANY CONTENT PUBLISHED ON OR LINKED TO THIS RESEARCH DATA INFRASTRUCTURE WITHOUT FIRST MAKING YOUR OWN ENQUIRIES TO VERIFY IT IS ACCURATE, CURRENT AND COMPLETE. Governing Law

Information included in the PDC RDI is subject to the Copyright Act. Unauthorized use of the Contents may violate copyright, trademark, and other laws.

Changes to Terms

The CCIN may modify or change these Terms of Use, in whole or in part, at any time and without notice. Please ensure that you review these Terms of Use and Service Terms regularly to ensure you remain in compliance. If any part of any term is held to be invalid or otherwise unenforceable, the affected part of the term will be deemed severed and the remainder of the terms will continue in full force and effect.

Termination

If you violate these Terms of Use or other policies and guidelines posted on this Site, your permission to use the Data automatically and immediately terminates and you must immediately destroy any copies you have made of the Data and Content. Furthermore, the CCIN may, in its sole discretion, cancel or suspend your access to the Data without notice and for any reason, including anything which the CCIN, in its sole discretion, believes is a breach of these Terms of Use or is otherwise unlawful or harmful to others. In the event of cancellation or suspension, you will no longer be authorized to use or reproduce this Data, and the CCIN may use any means possible to enforce its decision. Such cancellation or suspension will not affect any person who has received the datasets from you and who is otherwise in compliance with these Terms of Use.
